Terms of Service

These terms apply to your use of the Tarka desktop app, the tarka.website site and your Tarka account (together, “Tarka”). Tarka is a free, personal project made available by its author, Pavan Kulkarni, an individual (“the author”, “we”, “us”). By downloading, signing in to or using Tarka you agree to these terms. If you do not agree, do not use Tarka.

Free of charge, no commercial relationship

Tarka is provided at no cost. We do not charge fees, sell subscriptions or accept payment for Tarka, and nothing in these terms or in your use of Tarka creates a commercial, employment, agency, partnership or service relationship between you and the author. Tarka is offered as a hobby project, not as a business.

License

Subject to these terms, you receive a personal, non-exclusive, non-transferable, revocable license to install and use Tarka. Tarka is licensed, not sold. We may revoke this license at any time, for any reason, without notice. You may not reverse engineer, redistribute, resell or sublicense Tarka except where the law allows it regardless of this term.

Your account

You are responsible for activity under your account and for keeping access to it secure. You must be legally able to agree to these terms.

Your databases, your data, your agents

You keep all rights to your data. You alone are responsible for the databases you connect, for having permission to access them, and for every query run through Tarka, whether you typed it or an AI agent you connected sent it. Tarka includes safeguards, such as confirmations and approvals for destructive statements, but they are best-effort and cannot prevent every mistake, misuse or data loss. You accept that risk. Keep backups, use appropriately scoped database credentials, and do not point agents at data you cannot afford to lose.

Acceptable use

• Do not use Tarka to access systems or data you are not authorized to access.
• Do not use Tarka in violation of any law or regulation.
• Do not attempt to disrupt or misuse the sign-in service.
• Do not use Tarka in any setting where a failure could cause injury, death or serious damage, such as life support, safety systems or critical infrastructure.

Third-party services

Sign-in is provided by WorkOS and Google, downloads are hosted by Vercel, and the AI tools you choose to connect are provided by others. We do not control those services and are not responsible for them. Your use of them is subject to their own terms.

No support, availability or continuity

We have no obligation to provide support, maintenance, updates, bug fixes or security patches. We may update, change, suspend or discontinue Tarka, its sign-in service or any feature at any time, without notice or liability. We may suspend or terminate accounts that violate these terms. If the terms change, we will update the date at the top of this page; continuing to use Tarka after a change means you accept the updated terms.

No warranty

TARKA IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY AND QUIET ENJOYMENT. WE DO NOT WARRANT THAT TARKA WILL BE UNINTERRUPTED, ERROR-FREE, SECURE OR FREE OF HARMFUL COMPONENTS, THAT DEFECTS WILL BE CORRECTED, OR THAT ANY QUERY, SAFEGUARD OR RESULT WILL BE CORRECT OR COMPLETE. YOU USE TARKA ENTIRELY AT YOUR OWN RISK.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, THE AUTHOR WILL NOT BE LIABLE TO YOU OR ANYONE ELSE FOR ANY DAMAGES OF ANY KIND ARISING OUT OF OR RELATED TO TARKA OR THESE TERMS, INCLUDING DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE AND CONSEQUENTIAL DAMAGES, LOSS OR CORRUPTION OF DATA, LOSS OF REVENUE, PROFITS, BUSINESS OR GOODWILL, DOWNTIME, OR THE COST OF SUBSTITUTE SOFTWARE OR SERVICES, UNDER ANY THEORY OF LIABILITY (CONTRACT, TORT INCLUDING NEGLIGENCE, STRICT LIABILITY OR OTHERWISE), EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THIS INCLUDES DAMAGE CAUSED BY STATEMENTS RUN AGAINST YOUR DATABASES BY YOU OR BY AN AI AGENT YOU CONNECTED. BECAUSE TARKA IS FREE, IF ANY LIABILITY IS FOUND DESPITE THIS SECTION, THE AUTHOR'S TOTAL LIABILITY FOR ALL CLAIMS WILL NOT EXCEED ONE US DOLLAR (US$1). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE PLACES THIS SECTION APPLIES TO THE GREATEST EXTENT THE LAW PERMITS.

Indemnity

You will defend, indemnify and hold harmless the author from any claim, loss, liability, damage or expense (including reasonable legal fees) arising from your use of Tarka, the databases and data you connect, the queries you or your agents run, or your breach of these terms or of any law.

General

These terms are governed by the laws of the State of California, USA, without regard to conflict-of-law rules, and any dispute will be brought in the state or federal courts located in California. If any part of these terms is found unenforceable, the rest stays in effect. These terms are the entire agreement between you and the author about Tarka. Our not enforcing a term is not a waiver of it.
